entra\u00eenant une plus grande connectivit\u00e9 et rendant plus floues les fronti\u00e8res entre vie professionnelle et vie priv\u00e9e. Ces changements ont eu un impact sur le bien-\u00eatre des travailleurs et, en r\u00e9ponse, les employeurs, les employ\u00e9s et les d\u00e9cideurs au Canada s\u2019interrogent sur la mani\u00e8re d\u2019\u00e9laborer et de mettre en \u0153uvre des politiques de droit \u00e0 la d\u00e9connexion.&nbsp;<\/p>\n\n\n\n<p>Cette recherche a permis d\u2019identifier les aspects juridiques, op\u00e9rationnels et politiques de la mise en \u0153uvre d\u2019une politique de droit \u00e0 la d\u00e9connexion en examinant la mani\u00e8re dont les provinces canadiennes et d\u2019autres pays ont abord\u00e9 la question. Le d\u00e9bat sur le droit des travailleurs \u00e0 se d\u00e9connecter du travail au Canada a pris de l\u2019ampleur \u00e0 la suite de l\u2019\u00e9laboration d\u2019une l\u00e9gislation sur le droit \u00e0 la d\u00e9connexion dans l\u2019Union europ\u00e9enne (UE), qui devrait \u00e9clairer les d\u00e9cideurs politiques au Canada sur des consid\u00e9rations op\u00e9rationnelles essentielles.&nbsp;<\/p>\n\n\n\n<p>M\u00eame s\u2019il n\u2019existe pas d\u2019approche unique, la pr\u00e9valence continue et le d\u00e9sir des travailleurs de continuer \u00e0 travailler \u00e0 domicile, au moins une partie du temps, signifie qu\u2019il existe un besoin de politiques de droit \u00e0 la d\u00e9connexion au Canada. Les d\u00e9cideurs politiques peuvent utiliser cette recherche et ces id\u00e9es comme guide pour une mise en \u0153uvre efficace.<\/p>\n\n\n\n<div class=\"wp-block-group key-insights-grey has-background is-layout-constrained wp-block-group-is-layout-constrained\" style=\"background-color:#0000000d\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\"><strong>Perspective cl\u00e9<\/strong><\/h5>\n\n\n\n<p class=\"is-style-default is-flex\"><img decoding=\"async\" class=\"wp-image-243230\" style=\"width: 40px;margin-right: 16px\" src=\"https:\/\/fsc-ccf.ca\/wp-content\/uploads\/2024\/07\/No.svg\" alt=\"\">Selon le minist\u00e8re de l\u2019Emploi et du D\u00e9veloppement social du Canada, 93&nbsp;% des personnes interrog\u00e9es estiment que les employ\u00e9s devraient avoir le droit de refuser de r\u00e9pondre \u00e0 des communications li\u00e9es au travail hors des heures de travail.<\/p>\n\n\n\n<p class=\"is-flex\"><img decoding=\"async\" class=\"wp-image-243230\" style=\"width: 40px;margin-right: 16px\" src=\"https:\/\/fsc-ccf.ca\/wp-content\/uploads\/2024\/07\/No-1.svg\" alt=\"\">Pour que les politiques de droit \u00e0 la d\u00e9connexion soient efficaces, les organisations doivent tenir compte de leurs besoins sp\u00e9cifiques et des impacts juridiques, politiques et op\u00e9rationnels d\u2019une mise en \u0153uvre r\u00e9ussie.<\/p>\n\n\n\n<p class=\"is-flex\"><img decoding=\"async\" class=\"wp-image-243230\" style=\"width: 40px;margin-right: 16px\" src=\"https:\/\/fsc-ccf.ca\/wp-content\/uploads\/2024\/07\/No-2.svg\" alt=\"\">Les politiques relatives au droit \u00e0 la d\u00e9connexion doivent d\u00e9finir les secteurs \u00e9ligibles, ce qui est exempt\u00e9 et qui l\u2019est, et ce que sont les heures non travaill\u00e9es.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<div id=\"the-issue\" class=\"wp-block-ob-blocks-anchor-point\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column gradient-top purple is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\">\n<h3 class=\"wp-block-heading has-black-color has-text-color\" id=\"TheChallenge\"><img decoding=\"async\" class=\"wp-image-240812\" style=\"width: 12px;height: 24px;margin-right: 10px;position: relative;top: -2px\" src=\"https:\/\/fsc-ccf.ca\/wp-content\/uploads\/2024\/07\/Vector-2.svg\" alt=\"\"> <strong>L\u2019enjeu<\/strong><\/h3>\n\n\n\n<div class=\"wp-block-group flex-print is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<p>Le travail \u00e0 domicile, cons\u00e9quence de la pand\u00e9mie, a entra\u00een\u00e9 une augmentation de la connectivit\u00e9 et a rendu plus floue la fronti\u00e8re entre vie professionnelle et vie priv\u00e9e pour de nombreux employ\u00e9s. L\u2019intensification de la collaboration \u00e0 l\u2019\u00e9chelle mondiale, la possibilit\u00e9 limit\u00e9e de prendre des vacances pendant la pand\u00e9mie et les attentes croissantes des employeurs, qui veulent \u00eatre disponibles vingt-quatre heures sur vingt-quatre, ont amen\u00e9 un responsable politique fran\u00e7ais \u00e0 d\u00e9crire la situation comme une \u00ab\u2009laisse \u00e9lectronique\u2009\u00bb pour les travailleurs, qui quittent physiquement le bureau, mais restent attach\u00e9s \u00e0 l\u2019entreprise. Les effets sont ressentis de mani\u00e8re plus aigu\u00eb par certains types de travailleurs, en particulier les femmes qui effectuent d\u00e9j\u00e0 davantage de travail non r\u00e9mun\u00e9r\u00e9 \u00e0 la maison et qui ont \u00e9t\u00e9 particuli\u00e8rement touch\u00e9es par les attentes croissantes en mati\u00e8re de disponibilit\u00e9 en dehors des heures de travail normales.&nbsp;<\/p>\n\n\n\n<p>Cette situation a eu un impact profond sur le bien-\u00eatre des travailleurs de tous les secteurs, nombre d\u2019entre eux \u00e9voquant un stress accru pour eux-m\u00eames et leur famille, et reconnaissant que les employ\u00e9s surmen\u00e9s sont plus susceptibles de se blesser, de tomber malades et de s\u2019absenter du travail.<\/p>\n\n\n\n<p>En raison de ces effets n\u00e9gatifs, de nombreux travailleurs ont commenc\u00e9 \u00e0 r\u00e9clamer un droit \u00e0 la d\u00e9connexion, afin de permettre aux personnes de se d\u00e9connecter du travail et de ne pas s\u2019engager dans des communications relatives au travail en dehors des heures de travail, afin d\u2019am\u00e9liorer la qualit\u00e9 de l\u2019emploi, ainsi que la qualit\u00e9 de la vie. Compte tenu de l\u2019ampleur mondiale du probl\u00e8me, l\u2019Organisation mondiale de la sant\u00e9 a appel\u00e9 les gouvernements et les employeurs \u00e0 mieux prot\u00e9ger la sant\u00e9 des travailleurs gr\u00e2ce \u00e0 des politiques de droit \u00e0 la d\u00e9connexion. Nombreux sont ceux qui soutiennent le droit \u00e0 la d\u00e9connexion, car il est consid\u00e9r\u00e9 comme essentiel \u00e0 l\u2019\u00e9tablissement d\u2019une conciliation travail-vie personnelle, contribuant au bien-\u00eatre physique et mental des employ\u00e9s, et susceptible de r\u00e9duire le risque d\u2019\u00e9puisement des employ\u00e9s en les encourageant \u00e0 se d\u00e9connecter compl\u00e8tement, \u00e0 se reposer et \u00e0 r\u00e9cup\u00e9rer, ce qui se traduit par une augmentation g\u00e9n\u00e9rale de la productivit\u00e9.&nbsp;<\/p>\n\n\n\n<p>Le concept de politique de droit \u00e0 la d\u00e9connexion a \u00e9t\u00e9 mis en \u0153uvre pour la premi\u00e8re fois en France en 2017, lorsque le gouvernement a adopt\u00e9 une loi visant \u00e0 prot\u00e9ger le droit des travailleurs \u00e0 ignorer les messages en dehors des heures de travail. D\u2019autres pays europ\u00e9ens, comme l\u2019Espagne, l\u2019Irlande et l\u2019Italie, ont suivi le mouvement et adopt\u00e9 des lois similaires.&nbsp;<\/p>\n\n\n\n<p>Au Canada, avant la pand\u00e9mie, le droit \u00e0 la d\u00e9connexion b\u00e9n\u00e9ficiait d\u2019un certain soutien public et les d\u00e9cideurs politiques avaient envisag\u00e9 des options pour aider les travailleurs \u00e0 se d\u00e9connecter et \u00e0 am\u00e9liorer la conciliation travail-vie personnelle, mais les changements l\u00e9gislatifs propos\u00e9s ont \u00e9chou\u00e9, l\u2019opposition s\u2019\u00e9tant manifest\u00e9e contre des restrictions obligatoires. Il s\u2019agit notamment de&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consid\u00e9rations juridiques pour comprendre comment d\u00e9finir des concepts cl\u00e9s&nbsp;: quels employ\u00e9s ont le droit de se d\u00e9connecter, par exemple seulement les travailleurs \u00e0 distance\u2009?<\/li>\n\n\n\n<li>Les incidences sur l\u2019autonomie des travailleurs et des employeurs\u2009; par exemple, les employ\u00e9s peuvent-ils consentir \u00e0 se connecter et quand les employ\u00e9s seraient-ils oblig\u00e9s de se connecter\u2009?&nbsp;<\/li>\n\n\n\n<li>Les implications op\u00e9rationnelles, y compris la mani\u00e8re dont les politiques seraient mises en \u0153uvre et appliqu\u00e9es, et l\u2019impact qu\u2019elles pourraient avoir sur les politiques et les normes d\u2019emploi actuelles.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<div id=\"what-were-learning\" class=\"wp-block-ob-blocks-anchor-point\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column gradient-top purple is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\">\n<h3 class=\"wp-block-heading has-black-color has-text-color\" id=\"TheResult\"><img decoding=\"async\" class=\"wp-image-240819\" style=\"width: 24px;height: 24px;margin-right: 10px;position: relative;top: -2px\" src=\"https:\/\/fsc-ccf.ca\/wp-content\/uploads\/2024\/07\/Fill-1-1.svg\" alt=\"\"> <strong>Ce que nous apprenons<\/strong><\/h3>\n\n\n\n<p><strong>La r\u00e9action du Canada.&nbsp;<\/strong><\/p>\n\n\n\n<p>Si les lois de l\u2019UE ont suscit\u00e9 un d\u00e9bat au Canada sur le droit \u00e0 la d\u00e9connexion, avant la pand\u00e9mie, il y a eu peu de mouvements au Canada pour cr\u00e9er officiellement des politiques ou des lois. L\u2019impact de la COVID-19 a rendu cette question plus pressante, le gouvernement reconnaissant l\u2019importance de la conciliation travail-vie personnelle et convoquant \u00e0 nouveau son comit\u00e9 consultatif sur le droit \u00e0 la d\u00e9connexion afin d\u2019orienter les progr\u00e8s dans ce domaine. L\u2019Ontario est devenue la premi\u00e8re province \u00e0 adopter une loi sur le droit \u00e0 la d\u00e9connexion au Canada, qui oblige les employeurs de l\u2019Ontario soumis \u00e0 la r\u00e9glementation provinciale \u00e0 se doter d\u2019une politique \u00e9crite sur la d\u00e9connexion du travail. Le gouvernement f\u00e9d\u00e9ral a d\u00e9clar\u00e9 qu\u2019il pr\u00e9voyait de pr\u00e9senter une proposition qui s\u2019appliquerait aux lieux de travail r\u00e9glement\u00e9s par le gouvernement f\u00e9d\u00e9ral.<\/p>\n\n\n\n<p><strong>Approches globales.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Il existe deux approches principales pour l\u2019adoption de lois et de politiques sur le droit \u00e0 la d\u00e9connexion bas\u00e9es sur les mod\u00e8les de l\u2019UE&nbsp;:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une approche mandat\u00e9e par le gouvernement, souvent appel\u00e9e mod\u00e8le l\u00e9gislatif fran\u00e7ais, qui r\u00e9glemente les communications \u00e9lectroniques en dehors des heures de travail par le biais de lois&nbsp;&nbsp;&nbsp;<\/li>\n\n\n\n<li>Une approche volontaire d\u2019autor\u00e9gulation, souvent appel\u00e9e mod\u00e8le allemand d\u2019autor\u00e9gulation, dans laquelle les entreprises adoptent des politiques qui conviennent le mieux \u00e0 leurs travailleurs.<\/li>\n<\/ul>\n\n\n\n<p>Diff\u00e9rents pays, dont l\u2019Espagne, l\u2019Italie et l\u2019Irlande, ont emprunt\u00e9 des principes aux deux approches pour mettre en \u0153uvre leurs propres lois et politiques sur le droit \u00e0 la d\u00e9connexion. Les d\u00e9cideurs politiques canadiens peuvent tirer parti des principaux enseignements op\u00e9rationnels, notamment en ce qui concerne la meilleure fa\u00e7on d\u2019appliquer les politiques.&nbsp;<\/p>\n\n\n\n<p>La conception et la mise en \u0153uvre des politiques de droit \u00e0 la d\u00e9connexion sont complexes. Dans les deux mod\u00e8les, les employeurs ont besoin d\u2019aide pour identifier les employ\u00e9s auxquels les politiques s\u2019appliquent et l\u2019impact qu\u2019elles peuvent avoir sur d\u2019autres politiques du lieu de travail.
